    NICS denial for 1st time after special order was sold

    I received a NICS denial today or the first time ever. Let me give the full back ground;
    I am a Federal employee of DHS.
    My security clearance check was recently redone when my name was selected on random audit. It was approved with no problems.
    I have a C&R license that was recently renewed and my WV CCW was issued last year.
    I have taken delivery of two guns in the last six months without issue.

    Four months ago I placed an order at Valley Guns II in Inwood WV for the Colt Anniversary 1911 and prepaid in full while I had he cash.
    They had not received the pistol whenever I checked.
    Today I stopped again and was told that it arrived 11/30 and they claimed they left a voice message that price had increased. I did not received any message. Had I received one I would have gladly paid a few bucks and taken delivery.
    They said that when I had not responded by 12/5 they sold the gun to someone else. The store was very crowded and I asked that they confirm that they had sold a gun that was special ordered and was pre-paid in full.
    The clerk quickly consulted superiors and meetings were held in back rooms and they decided to sell me an Anniversary 1911 they had a deposit on.

    I filled out the form and the sales clerk left he floor to call it in. Fifteen minutes later he returns with the form and my cash to inform me the sale was denied and they had to refund my cash. I stated that I had NEVER received a denial and was adamant about getting the Colt. They gave me the standard appeal brochure and said they would hold the Colt until Feb. 1st.

    My questions are; 1, has anyone ever dealt with a denial? and 2, am I wrong to suspect some attempt to get out of delivering that gun to me at the agreed price?

    I am arranging to have fresh fingerprints taken on Tuesday and sent in. Can i get this process done in 30 days?

    If you were actually denied or delayed they should have given you an alphanumeric code on the brochure where you can call FBI/NICS with that case #. I was delayed right before Christmas and called in with the number. A very pleasant lady put me on hold for about a minute then returned and said everything okay they must have been really busy. Dealer said they had called them back about 15 minutes after I left. To apply for special PIN# you do have to send in fingerprints, they suggested I not do that unless delays become regular. I guess the other advantage of the PIN# is you don't need your SS#. I know its not required but it usually allows for a proceed response. Good luck!

    It was denied, ans I have the transaction code, however FBI will give me no info until they receive a fresh set of finger prints for ID.

    Good luck, Crossfire. I am eager to hear how this turns out. Hopefully, it is just another government error, and they will correct it and that is the end of it.

    This sounds like the goverment being the goverment.Being you are DHS with a security clearance you can do something about it.

    WV must have some other kind of process then Texas. With a CHL (what you call a CCW) you fill out the 4473 form, show them your drivers license and CHL, pay your money, get your weapon and walk away.

    Doesn't make sense why the FBI would deny or the store gain anything by giving you a refund. Why would they deny themselves a sale? Ask for a number - code # - as others mentioned the FBI Reject should have - and take it from there. But to me it a pretty senseless and confusing situation all around.

    If they sell get to sell the 100th Anniversary Colt to someone else they could receive the current market value. When it originally came in they learned that they had sold me the gun at low price and that their cost was barely covered.

    Maybe he sold the first one at a higher price to a buddy??? After the circumstances of the first gun the only option he saw on the second gun was a claim of denial?? Don't know but there is doubt in the facts as he (the dealer) presents them. Have uou dealt with him before?? What is his reputation in the area??

    Don't feel Bad,,, Every Employee that Works at AREA 51, North of Las Vegas is Delayed, Standard Operating Procedure. This happened with Civilians and One Air Force General that was a regular customer of mine in Las Vegas . No explanation was ever given; not even to the purchaser.
